Stockabl Product Guidelines

1. Product Compliance

It is your responsibility as a Maker on the Stockabl marketplace to make sure that your products meet the guidelines and requirements we provide here. We reserve the right to periodically update these guidelines as necessary, so it is recommended that you review them regularly.

As a Maker on the Stockabl platform you acknowledge and agree to the following:

  1. You will abide by these Product Guidelimnes, the Stockabl Terms of Use, and the Stockabl Maker Terms.
  2. You will comply with all applicable laws, rules, and regulations regarding your products. This includes things related to safety, labeling, testing, warning, import/export, regional certifications, and any and all other applicable consumer protection laws.
  3. You will not infringe upon another’s intellectual property (regardless of if they are on the Stockabl platform or not). You will not use the trademarks or likeness of other third parties without permission.
  4. You will not provide intentionally false, inaccurate, or misleading information about any of your products.
  5. You will not sell products that are prohibited in your regional area, nor will you sell products to Retailers that are prohibited in their regional area.

You also acknowledge and agree that Stockabl is not responsible for making sure that you are meeting the above requirements. You release Stockabl from any liability related to your products or the sale of them. Your compliance with Product Guidelines is required for you to continue to sell on the Stockabl marketplace.

2. Definitions

  1. Handmade” means that the product was handmade, hand-assembled, or hand-altered by you or a member of your team from more than one component that was made by you or purchased from a supplier. This does not include products that are composed primarily or entirely of components designed by a third-party without significant alteration by you or your team.
  2. Independently Designed” means that the original creative work was imagined, designed, and legally owned by you but that you require production assistance from third-parties that are not directly employed by you (for example, printing, casting, fabrication, etc.).

3. Prohibited Products

Stockabl does not allow any of the following products on the Stockabl marketplace:

  • Products that are not handmade or independently designed
  • Counterfeit products or products that you do not have the right to sell (i.e., products that were not made by you or for your brand)
  • Weapons of any kind
  • Products that contain alcohol or drugs of any kind
    • This includes products that contain Cannabidiol (CBD) – this is due to restrictions on our payment processing. If you are affected by this prohibition and would like to be informed if the situation changes in the future, please submit a support ticket.
  • Any hazardous, toxic, flammable, biohazardous, unsafe or dangerous products
  • Animal or animal products (excluding leather goods or fur)
  • Pornography of any kind
  • Products that are offensive or promote, incite or glorify hate or violence towards any person or group
  • Digital goods, including software or gift cards
  • Any perishable foods
  • Any products containing asbestos or flame-retardant chemicals
  • Used or vintage goods
  • Any other products that Stockabl determines in its discretion to be inappropriate for availability on the Stockabl marketplace.

4. Compliance with Laws

It is your responsibility as a Maker to be familiar with and comply with all applicable laws, rules, and regulations that are relevant to the products you make and sell on Stockabl. These laws, rules, and regulations may be international, federal, state, local or otherwise. This includes the following (but please note this list is not exhaustive and it is your responsibility to know what laws, rules and regulations apply to you):

  1. Packaging and product labeling laws (apparel or otherwise)
  2. “Made in America” laws
  3. Eco-friendly laws
  4. Plastic bag warning labels and laws
  5. California’s Prop 65 (the Safe Drinking Water and Toxic Enforcement Act of 1986)
  6. California’s Compliance with Metal Containing Jewelry law

5. Product Recalls

You agree to inform Stockabl immediately in the event that any of your products have been recalled. When doing so please provide the following information: (1) product name; (2) SKU used to identify the product in our system; (3) why the products are being recalled; (4) order numbers containing recalled products; (5) any other information that might be necessary for us to insure the products are rapidly and accurately recalled.

6. Violation of These Product Guidelines

If you fail to meet any of these Product Guidelines, Stockabl has the right to deactivate products. We also have the right to suspend your account temporarily or permanently terminate your account and/or Stockabl’s General Terms and/or Maker Terms. This is exclusively up to our sole discretion and we can do so without notifying you in advance.
